Aura Wellness Studio LLC (“Studio,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you (the “Member,” “you,” or “your”) access or use our website at aurawellnessstudio.com (the “Website”), or the software and mobile application operated by Mindbody, Inc. (the “App”), participate in yoga, Pilates, fitness, wellness, or other related physical or recreational sessions offered by the Studio (collectively, the “Activities”), or use any other related administrative, scheduling, booking, purchasing, account management, or communication services provided by the Studio (collectively, the “Other Services,” and together with the Website, App, and Activities, the “Studio Services”). This Privacy Policy is incorporated into and forms part of the Terms and Conditions (the “Terms”).

PLEASE READ THIS NOTICE CAREFULLY to understand our policies and practices for processing and storing your personal data. By accessing or using any of the Studio Services, you agree to this Privacy Policy and to the Terms. If you do not agree, you must not use the Studio Services.

Information We Collect or Receive 

In the course of operating the Studio Services, including the Website and the App, we collect and/or receive information from you directly, automatically, and from third-party service providers (collectively, the “Service Providers”) that support or facilitate the Studio Services. By using the Studio Services, you authorize the Studio to collect and receive such information as described in this Privacy Policy.

Personal Information

We only receive or collect information that identifies you personally if you choose to provide such personally identifiable information to us via email or other means. When you sign up to become a member or contact us, you will be required to provide us with personal information about yourself (collectively, the "Personal Information"). Such Personal Information may include:

• Your name, email address, physical address, and phone number

• Account registration details, including username and password (if applicable) or other similar identifier

• Payment information (processed securely through the App

• Booking, attendance, and membership details

• Health or fitness information voluntarily provided for safe participation in Activities

• Communications with the Studio, including emails, texts, or messages sent through the App or Website

Other Information

In addition to Personal Information, we may collect, generate, or receive other types of data that do not directly identify you (collectively, “Other Information”). Other Information may include technical, aggregated, or de-identified data such as device information, usage patterns, or analytics derived from your interactions with the Studio Services. If we combine or connect Other Information with Personal Information so that it directly or indirectly identifies an individual, we treat the combined data as Personal Information.

Information Collected Automatically

When you access or use the Website or App, certain data may be collected automatically through cookies, log files, analytics tools, and similar technologies. This may include some of the categories of Other Information described above, such as device type, IP address, operating system, browser, session activity, and navigation behavior.

This automatically collected data helps the Studio maintain system performance, diagnose technical issues, and understand how Members use the Studio Services. Cookies and tracking technologies may also be used to personalize your experience and improve functionality. You may choose to disable or limit cookies through your browser or device settings; however, doing so may limit certain features of the Studio Services.

How Information is Collected

The Studio collects Personal Information and other data from Members in several ways, depending on how you access or use the Studio Services. Information may be provided directly by you, collected automatically when you interact with the Website or App, or obtained from third-party Service Providers that support the Studio Services.

Information You Provide Directly

We collect Personal Information that you choose to provide directly to the Studio, including when you: 

• Register for or schedule Activities

• Create or manage an account via the App or Website

• Make purchases, submit payment information, or manage membership details

• Contact the Studio by email, phone, or in person

• Voluntarily share health, fitness, or participation preferences to ensure safety during Activities

Information Collected Through the App 

The App supports many of the administrative and transactional functions of the Studio Services, including class scheduling, booking, account registration, membership management, and payment processing. When you interact with the Studio through the App, certain Personal Information is collected and processed by the App provider, Mindbody, Inc., on behalf of the Studio to enable these functions.

If you sign in, register, or make a purchase through the App, you authorize the Studio to collect, store, and use, in accordance with this Privacy Policy, the Personal Information that you have agreed the App may share with us. This may include account and transaction details necessary to facilitate your participation in the Studio Services.

The App operates independently of the Studio and maintains its own privacy policy and terms of use. Members are encouraged to review the App’s Privacy Policy, Consumer Agreement, and applicable terms and conditions for additional details regarding its collection, use, and protection of Personal Information.

Information Obtained Through Third-Party Services, Analytics, and Location Technologies

The Studio Services rely on certain third-party technologies and Service Providers to operate effectively and enhance the Member experience. When you access or use the App or Website, these integrated services may automatically collect limited Personal Information on behalf of the Studio to enable functionality, security, and analytics.

This information may be collected through tools and platforms that support payment processing, hosting, scheduling, email communications, and analytics. These technologies help the Studio maintain system performance, diagnose technical issues, personalize communications, and understand how Members interact with the Studio Services. 

Third-Party Service Providers

The Studio works with trusted third-party Service Providers to deliver certain aspects of the Studio Services. These providers may process limited Personal Information to help manage transactions, host and secure systems, and deliver communications. Each provider is contractually required to protect Personal Information in accordance with applicable privacy laws and may use data only as necessary to perform its designated functions on behalf of the Studio.

Analytics and Tracking Technologies

Analytics and tracking technologies, such as cookies, tags, or pixels, may record technical details including device type, browser, session activity, and referral sources. This information helps the Studio improve the design, usability, and performance of the Website and App. Members can manage or disable cookies through their browser or device settings; however, some functionality may be limited if tracking is disabled.

Geolocation Data

The App may request permission to access limited geolocation data from your mobile device to enable optional features such as class check-ins or location-based notifications. Collection of this information occurs only when location services are active and permissions are granted. You may disable access to location data at any time in your device settings.

Cookies and Similar Technologies

The Website and App use cookies and similar technologies, such as tags, pixels, and local storage to improve functionality, analyze usage, and personalize your experience. Cookies are small files placed on your device that help the Studio recognize you, maintain your preferences, and understand how you interact with the Studio Services.

We use both essential cookies (necessary for security and basic operation) and optional cookies (used for analytics, performance, and marketing). Your browser or device may allow you to block or delete cookies; however, doing so may limit certain features or functionality.

The Cookie Policy provides detailed information about how cookies and tracking technologies are deployed across the Website and App, including how you can modify your settings or withdraw consent through browser controls or cookie-management tools.

Information Collected By or Through Third-Party Advertising Companies 

Users who register or make purchases through the App do so under the App’s own Terms and Conditions and Privacy Policy, which govern how data is collected, stored, and shared by the App and its network of subscriber businesses, including the Studio. As a subscriber business within that network, the Studio may receive limited Personal Information or Other Information that helps the Studio communicate with Members and improve the relevance of its marketing.

We may share or receive Other Information about your activity on the App or Website with third parties that provide advertising, analytics, or marketing support services. This information may be used for ad distribution, measurement, and optimization, including the tailoring, targeting (behavioral, contextual, and retargeting), analysis, management, reporting, and improvement of advertisements relating to the Studio Services.

These third parties may use cookies, pixel tags (also called web beacons or clear GIFs), and similar technologies to collect Other Information for these purposes. Pixel tags enable us and our advertising partners to recognize a browser’s cookie when a user visits a site containing the pixel tag, allowing analysis of which advertisements lead users to our Website or App.

In some cases, we may also receive Other Information from advertisers or their service providers, such as advertising identifiers, IP addresses, and post-conversion data. This information is used solely to measure ad performance, understand engagement trends, and optimize marketing efforts in connection with the Studio Services.

All advertising partners and Service Providers are required to handle Personal Information and Other Information in a manner consistent with this Privacy Policy and applicable privacy laws.

How Information is Used and Shared

You authorize the Studio to use the Personal Information, Payment Information, Geolocational Information, and Other Information (collectively, the “Information”) to:

• Provide, operate, and improve the App and Website

• Deliver and enhance the Studio Services;

• Administer membership, scheduling, and promotional programs;

• Solicit feedback and respond to inquiries; and

• Inform Members about Studio products, services, offers, and updates. 

Sharing of Information with Third Parties

In order to provide and support the Studio Services, the Studio may share Information with trusted third-party Service Sroviders and marketing partners, including businesses that participate in the Studio’s programs or promotions.

The Studio also engages third-party companies and individuals to perform functions on our behalf. Examples include providing technical support, customer service, marketing assistance, and administration of promotional programs. These third parties are given access to Information only as necessary to perform their assigned functions and are required to handle such Information in accordance with applicable privacy laws and contractual obligations.

Aggregate and De-Identified Information

To better understand our Members, the App, and the Studio Services, we may analyze certain Information in aggregated or de-identified form. This helps us operate, maintain, manage, and improve our offerings. Such aggregated data does not identify you personally.

The Studio may share or license aggregated, anonymized data with affiliates, agents, business and promotional partners, and other third parties for lawful purposes, including research, analytics, and business development. We may also disclose aggregated user statistics to describe the Studio Services to prospective partners or investors.

Corporate Affiliates and Business Transfers

The Studio may share Information with its parent companies, subsidiaries, joint ventures, or other entities under common control.

As the Studio develops its business, it may buy, sell, or reorganize assets or entities. In the event of a merger, acquisition, reorganization, sale of assets, dissolution, or similar transaction, Information may be transferred as part of the business assets.

Legal Requirements and Protection of Rights

To the extent permitted by law, the Studio may disclose Information:

• When required by law, subpoena, court order, or governmental or regulatory request; or

• When the Studio believes that disclosure is necessary or advisable to protect the rights, property, or safety of the Studio, our Members, or others.

Your Choices and Opt-Out Rights

Members have rights and choices regarding how the Studio collects, uses, and shares Personal Information. The Studio provides reasonable methods to access, correct, delete, or limit certain uses of information collected through the Website or App.

Access, Correction, and Deletion Requests

Members may request access to the Personal Information maintained by the Studio, seek correction of inaccurate or incomplete information, or request that such information be deleted, subject to applicable legal exceptions.

For security reasons, the Studio may verify your identity before processing a request. Once verified, the Studio will respond within a reasonable period consistent with applicable data protection principles.

Limiting the Use or Sharing of Personal Information

Members may request that the Studio limit or stop the use of Personal Information for certain purposes, such as targeted marketing or promotional communications. The Studio does not sell Personal Information in exchange for monetary value, but may share limited Other Information (as defined above) with trusted partners who assist in delivering or improving the Studio Services.

Members can opt-out of marketing or promotional emails by clicking the “unsubscribe” link at the bottom of any marketing message. The Studio will use commercially reasonable efforts to process such requests promptly. You cannot opt-out of receiving transactional or administrative messages related to the Studio Services, such as appointment confirmations, billing notices, or updates about your account.

Mobile and Push Notifications

The App may send notifications or alerts, such as class reminders or updates. You may disable these notifications at any time by changing your settings within the App or on your mobile device.

Interest-Based Advertising

You may opt-out of receiving targeted or interest-based advertising by adjusting your browser or device settings, or by visiting the following opt-out pages

For mobile devices, you can also limit ad tracking:

• Android Users: Open Google Settings → Ads → Enable “Opt-out of interest-based advertising.”

• iOS Users: Go to Settings → Privacy → Advertising → Enable “Limit Ad Tracking.”

Please note that opting out of interest-based advertising does not mean you will no longer see advertisements; you will continue to receive general, non-personalized ads.

Data Security

The Studio implements commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. These measures are intended to maintain the confidentiality, integrity, and security of the information we collect and store.

Please understand, however, that no method of transmission over the internet or method of electronic storage is completely secure. The Studio cannot guarantee the absolute security of our systems or of the databases of any third parties that process information on our behalf, nor can we ensure that Personal Information you transmit to us will not be intercepted during transmission.

In particular, email sent to us may not be secure. You should exercise caution when choosing what information to send to the Studio by email and avoid including sensitive or financial information whenever possible.

Important Notices to Non-U.S. Residents

The App, Website, and related Studio Services are operated in the United States. If you are located outside of the United States, please be aware that your Personal Information and Other Information may be transferred to, processed, maintained, and used on computers, servers, and systems located within the United States, where privacy laws may not provide the same level of protection as those in your jurisdiction.

The Website, App, and all Studio Services are intended solely for use by individuals located within the State of California. Users who access the Studio Services from outside California do so at their own initiative and are responsible for compliance with any applicable local laws.

App Stores; External Websites 

Your app store (e.g., Apple App Store or Google Play) may collect certain information in connection with your use or download of the App, including Personal Information, Payment Information, Geolocational Information, and Other Information. The Studio has no control over the collection, use, or disclosure of such information by any third-party app store. Any collection, use, or disclosure of your data by those third parties is governed by their own privacy policies and terms of use.

The App and Website may also contain links to external or third-party websites. The Studio has no control over the privacy practices, security measures, or content of such external websites. When visiting a third-party site, you should review that site’s applicable privacy policy and terms of use or service to understand how your information may be collected, used, or disclosed.

Children Privacy

The Studio Services are not directed to children under the age of 13, and the Studio does not knowingly collect Personal Information from anyone under 13 years of age. If we become aware that Personal Information has been collected from a child under 13 without verifiable parental consent, we will delete that information promptly.

Individuals between the ages of 13 and 17 may only use the Studio Services with the consent and supervision of a parent or legal guardian. By allowing a minor to participate in Activities or register through the App or Website, the parent or legal guardian provides consent to the Studio’s collection and use of Personal Information in accordance with this Privacy Policy and the Terms and Conditions.

Parents or legal guardians who believe that their child has provided Personal Information to the Studio without consent should contact us immediately at [privacy@aurawellnessstudio.com] so that we can take appropriate action. 

Changes to this Privacy Policy 

This Privacy Policy is effective as of the date stated at the top of this notice. The Studio may update or modify this Privacy Policy from time to time to reflect changes in our practices, applicable laws, or operational needs.

Any material changes will be posted on the Website and within the App, along with an updated effective date. By continuing to access or use the Studio Services after such changes are posted, you acknowledge and agree to the revised Privacy Policy.

To the extent permitted by applicable law, our use of Personal Information is governed by the Privacy Policy in effect at the time such information is collected. We encourage Members to review this Privacy Policy periodically to stay informed about how the Studio protects Personal Information.
